Kedudukan Konstitusi dalam Menjamin Hak dan Kewajiban Warga Negara

Abstract

The constitution is a fundamental instrument in the administration of a state
because it serves as the highest legal foundation that regulates the relationship
between government institutions and citizens. This article aims to analyze the
position of the constitution in guaranteeing the rights and obligations of citizens
within a constitutional state. The study focuses on how constitutional principles
provide legal protection, establish limitations on state authority, and create a
balance between citizens’ rights and responsibilities. This research uses a
qualitative approach with a normative juridical method through literature studies,
including constitutional documents, legal theories, and relevant academic sources.
The findings indicate that the constitution has a strategic role in ensuring the
recognition, protection, and fulfillment of fundamental rights such as freedom,
equality before the law, political participation, and social welfare. In addition, the
constitution also regulates citizens’ obligations as a form of responsibility in
maintaining social order, national unity, and the sustainability of the state. A strong
constitutional system can prevent abuse of power and guarantee that government
actions remain based on legal principles and democratic values. Therefore, the
constitution is not only a legal document but also a reflection of the fundamental
agreement between the state and its citizens. The effective implementation of
constitutional values is essential to realizing a democratic, fair, and law-based
society. This study concludes that the constitution occupies a central position in
protecting citizens’ rights while ensuring the fulfillment of their obligations in
modern state life.
